Housing Disrepair Claims
Housing disrepair can include a wide range of issues such as damp, structural issues, mould, plumbing issues, leaks and roof problems.
In order to proceed you must have reported the repair issue to the local council/housing association within the last six months. You would need to provide proof that you have reported this. Proof can be in the form of emails, text messages, phone calls or written proof.
To qualify for a housing disrepair claim you must be a private individual in a council or housing association property and have been a tenant for at least three months. The property must be in England or Wales and you are required to provide a copy of your tenancy agreement.
You must have capacity to agree to instructing a solicitor to proceed with the housing disrepair claim. You must not be in rent arrears of £1000 or more and you must not have any ongoing eviction proceedings against you.
Claimant must be a private individual
Claimant must be the current tenant in the property and have been so for at least three months
Claimant must have capacity
Claimant must have no more than £1000 rent arrears and there must be no ongoing eviction proceedings
Claimant must have a copy of the Tenancy Agreement available for inspection
If a joint tenancy, both parties must agree to instruct solicitors
Property must be in England and Wales
Landlord must be a Council or Housing Association
Claimant must have reported the breach within last six months and have proof that they have done so on at least two separate occasions
There must be clear evidence that the disrepair is in breach of S.11 or is a breach of an express covenant in the tenancy agreement
Cost of reinstatement must exceed £1,000.
